Please read these Terms and Conditions ("Terms") carefully before using the www.flagged-out.com website ("Our Website") and placing any orders. By accessing or using Our Website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use Our Website or place an order.

These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

  1. Online Store Terms & Formation of Contract 2.1. By agreeing to these Terms, you confirm that you are of legal age to enter into a binding contract in your country of residence. 2.2. You may not use our products for any illegal or unauthorised purpose. 2.3. The display of goods on Our Website is an invitation to treat and not a contractual offer. 2.4. When you place an order through Our Website, you are making an offer to buy goods from us. 2.5. After placing an order, you will receive an email acknowledging receipt of your order. This email is an Order Confirmation, not an acceptance. Your order is accepted only when we dispatch the goods and send you a Dispatch Confirmation. 2.6. We reserve the right to refuse any order you place with us. 2.7. If we are unable to accept your order, we will inform you and refund any payment taken.

  2. Products, Prices and Payment 3.1. All prices are shown in GBP and EUR. Prices include taxes where applicable. 3.2. Prices may change at any time, but changes will not affect confirmed orders. 3.3. UK Customers: For customers in the UK, prices include VAT at the current rate. 3.4. EU Customers: For customers in the European Union, prices shown on the website may or may not include VAT depending on the chosen delivery country and the total order value.

  • If your order value is below €150 (or equivalent in your local currency) and we are registered with the EU Import One Stop Shop (IOSS), we may collect VAT at the rate applicable in your country at the point of sale. This will be shown clearly at checkout. No further VAT or customs duties should be payable upon delivery.

  • If your order value is above €150 (or equivalent), or if we are not using IOSS for orders below €150, the prices displayed do not include VAT or customs duties applicable in your country. You will be responsible for paying these charges directly to the courier or customs authorities in your country before or upon delivery. We are not responsible for these charges. Please check with your local customs authority for specific details. 3.5. Delivery costs are not included in the product price and will be added to your order total. Delivery costs are calculated based on the size, weight, destination of your order, and the chosen shipping method. You will see the applicable delivery costs at checkout before you confirm your order. 3.6. While we try to ensure all prices are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. 3.7. We accept payment via Visa, MasterCard, American Express, PayPal, and Apple Pay. 3.8. Payment must be received in full before goods are dispatched.

  1. Order Processing and Delivery 4.1. Orders are processed within 24–48 hours of payment confirmation. 4.2. Estimated delivery times after dispatch:

  • UK: 4–8 business days

  • EU: 8–10 business days

  • Rest of the world: 10–15 business days 4.3. We use Royal Mail for deliveries. Tracking numbers are provided. 4.4. No redelivery fees apply if you miss the first delivery attempt.

  1. No Returns Policy 5.1. All items are made to order. We do not accept returns unless the item is faulty or damaged. 5.2. Please ensure you select the correct size using the size guide available on each product page. We do not offer size exchanges. 5.3. If your item is faulty or damaged, please contact us within 7 days of delivery at hello@flagged-out.com and include photographs of the item. [Details on return process to be updated.]

  2. Cancellation Rights 6.1. As all products are made to order, your right to cancel under UK and EU distance selling regulations is waived once your order is placed.

  3. Faulty or Damaged Items 7.1. If your item arrives damaged or faulty, please notify us at hello@flagged-out.com with photographs of the issue. [Further details to be provided.] 7.2. Return postage for faulty items is not covered by flagged-out. [Exact process to be confirmed.]

  4. Our Liability 8.1. We are responsible for foreseeable loss or damage caused by our breach of these Terms. 8.2. We do not exclude or limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. 8.3. We are not liable for any business losses. Products are sold for personal use only. 8.4. We are not responsible for delays caused by events outside our reasonable control.

  5. Intellectual Property 9.1. All content on Our Website is the property of flagged-out or its content suppliers. 9.2. You may not copy, reproduce, or exploit any part of the website without written permission.

  7. Governing Law and Jurisdiction 11.1. These Terms are governed by the laws of England and Wales. 11.2. The courts of England and Wales shall have exclusive jurisdiction over disputes. 11.3. EU consumers retain their rights under mandatory consumer laws in their country of residence.

  8. Sales to EU Customers 12.1. By ordering for delivery to the EU, you acknowledge that the contract is formed in the UK. 12.2. EU customers are responsible for any import VAT or customs duties. Please check with your local customs authority before ordering.

  9. Changes to Terms 13.1. We may update these Terms at any time by posting an updated version on Our Website. 13.2. The Terms in force at the time you place an order will apply.
